Tucksy is an editorial parenting platform designed to help parents understand what may be happening during the messy, exhausting and confusing parts of early parenthood, particularly around baby and toddler sleep.

Our aim is simple:

Understand what's happening. Know what to do next. Feel less alone in it.

Tucksy may provide articles, newsletters, videos, stories, illustrations, interactive tools, Ask Tucksy conversations, journal features, digital resources, paid products and other parenting content.

You may use Tucksy for your own personal, non-commercial purposes.

You must not:

• use Tucksy unlawfully;
• attempt to gain unauthorised access to our systems, accounts or data;
• interfere with the security or operation of the service;
• introduce malicious software or code;
• scrape or systematically extract Tucksy content or data without permission;
• reproduce or republish substantial parts of Tucksy without permission;
• use Tucksy content to create or provide a competing commercial product or service;
• impersonate another person or misrepresent your identity;
• use Ask Tucksy abusively or attempt to manipulate, disrupt or exploit its systems; or
• use Tucksy in a way that infringes another person's rights.

We may reasonably restrict or suspend access where necessary to protect Tucksy, its users or its systems, or where these Terms have been materially breached.

Tucksy provides general educational, informational and decision-support content.

Tucksy is not medical advice, diagnosis, treatment, therapy, emergency support or a substitute for care from an appropriately qualified healthcare professional.

This applies to all Tucksy content and services, including Ask Tucksy.

Tucksy cannot examine your child, access their complete medical history or determine whether a medical condition is present.

If you are concerned about your baby's or child's health, feeding, breathing, growth, development, pain, illness, unusual sleepiness or behaviour, seek advice from an appropriate healthcare professional.

If you believe your child may require urgent medical attention, contact an appropriate emergency or urgent healthcare service rather than relying on Tucksy.

Tucksy may provide general information concerning baby sleep, bedtime, naps, night waking, routines and sleep environments.

Safe-sleep recommendations may differ depending on your location and may change as public-health guidance develops.

Always follow current safe-sleep guidance applicable where you live and advice provided by an appropriate healthcare professional.

Do not follow a Tucksy suggestion if it conflicts with professional medical advice applicable to your child or if you believe it would be unsafe in your circumstances.

Ask Tucksy is an interactive feature designed to help parents make sense of sleep and parenting situations.

You can describe what is happening and Ask Tucksy may provide general information, possible explanations, questions to consider and practical options.

Ask Tucksy may use artificial intelligence and automated systems to generate or support responses.

Ask Tucksy has limitations

Responses are generated using the information available to the service and the information you choose to provide.

Ask Tucksy:

• cannot observe or examine your child;
• does not have complete knowledge of your family's circumstances;
• may misunderstand information you provide;
• may occasionally provide incomplete, inaccurate or inappropriate information;
• cannot diagnose medical or developmental conditions; and
• should not be used for emergencies.

You remain responsible for deciding whether information provided through Ask Tucksy is appropriate for your circumstances.

Where something appears inconsistent, unsafe or concerning, do not rely on the response and seek appropriate professional advice.

Tucksy may allow registered users to save or return to previous Ask Tucksy conversations and create journal entries, notes or Previous Moments.

These features are provided for convenience and personal reflection.

You are responsible for the information you choose to record.

Please avoid including unnecessary identifying information or detailed medical records about your child or other people.

Availability of stored conversations and journal features may change as Tucksy develops. You should not use Tucksy as the sole permanent storage location for information you cannot afford to lose.

Our handling of information contained in these features is explained in our Privacy Policy.

Tucksy may analyse interactions with its services to identify recurring questions, experiences and themes among parents.

We may use aggregated or de-identified information to create editorial features such as What Parents Are Asking.

For example, we may publish a statement such as:

“50% of this week's conversations were about disrupted nights.”

Such statistics are intended to describe broader trends rather than individual users.

We will not intentionally publish a private Ask Tucksy conversation in identifiable form without appropriate permission.

Some Tucksy features may require an account.

You are responsible for:

• providing accurate account information;
• keeping your login credentials confidential;
• maintaining reasonable security over your account; and
• telling us promptly if you believe your account has been accessed without permission.

You must not knowingly allow another person to access paid or restricted services through your account unless the relevant service permits account sharing.

We may suspend or restrict an account where reasonably necessary for security, suspected fraud, misuse or a material breach of these Terms.

Tucksy is intended for adults, particularly parents, carers and guardians.

You must be at least 18 years old to create a Tucksy account, purchase a paid service or provide payment information.

Tucksy is not designed to be used directly by children.

Tucksy publishes editorial content about parenting, sleep and related subjects.

This may include:

• articles;
• newsletters;
• videos;
• illustrations;
• audio;
• bedtime stories and children's stories intended to be read or played by adults;
• guides;
• interviews;
• editorial features; and
• other media.

We aim to produce thoughtful and useful content, but parenting circumstances vary considerably.

Editorial content should therefore be treated as general information rather than personalised professional advice.

Tucksy may publish fictional stories, bedtime stories and other creative content featuring original characters, including Tucksy the koala.

Unless expressly stated otherwise, these stories are fictional and are primarily intended for entertainment, storytelling and parent-child engagement.

A fictional story should not be treated as medical, developmental, behavioural or sleep advice merely because it concerns sleep, bedtime, emotions or parenting.

If you subscribe to Tucksy marketing emails, we may send you editorial content, newsletters, parenting information, product announcements, offers and other Tucksy communications in accordance with our Privacy Policy and applicable law.

You can unsubscribe from marketing communications using the unsubscribe link in our emails.

We may separately send necessary service communications concerning your account, purchases or services you use.

Tucksy may offer paid digital products, subscriptions, memberships or other services.

Before purchasing, you will be shown the applicable price and important information about the product or service.

By placing an order, you agree to pay the price displayed at checkout.

Any important restrictions or recurring charges will be presented before you complete your purchase.

Nothing in these Terms reduces rights you have under applicable consumer law.

Where Tucksy offers a recurring subscription, we will provide relevant information about the subscription before purchase, including the price and billing frequency.

Recurring payments will be collected using your chosen payment method until the subscription is cancelled or otherwise ends.

You may cancel according to the cancellation method made available for the subscription.

Cancellation normally prevents future renewal rather than immediately removing access already paid for, unless otherwise stated or required by law.

If we materially change the price or important terms of an existing recurring subscription, we will provide notice where required and any rights required by applicable law.

Your cancellation and refund rights depend on what you purchase and applicable consumer law.

Digital content supplied immediately

Where you purchase digital content and ask us to provide access during a statutory cancellation period, we may ask you to expressly consent to immediate supply and acknowledge that you may lose your statutory right to cancel once supply begins.

Your statutory cancellation right will only be affected to the extent permitted by applicable law.

Services

Different cancellation rules may apply to services and subscriptions.

Where a statutory cancellation period applies and you request that a service begins during that period, you may in some circumstances be required to pay for the service supplied before cancellation.

Refunds

Nothing in this policy removes rights you may have where digital content or a service is faulty, misdescribed or not provided with the standard required by law.

If Tucksy separately offers a refund guarantee that is more generous than your statutory rights, the terms of that guarantee will be displayed with the relevant offer.

Prices will be displayed before purchase.

Payments may be processed by a third-party payment provider.

You agree to provide accurate payment and billing information and to use a payment method that you are authorised to use.

Additional taxes or charges will be displayed where required.

You may provide information through Ask Tucksy, Journal, forms, surveys, reviews, feedback and other interactive features.

You retain ownership of content you provide.

You give Tucksy the limited rights reasonably necessary to process, store and use that content to operate the service you requested and for other purposes described in our Privacy Policy.

Providing content to Tucksy does not automatically give us permission to publicly identify you or publish your private conversations.

You must not knowingly submit content that:

• you do not have the right to provide;
• unlawfully infringes another person's rights;
• contains malicious software; or
• is unlawful.

If you voluntarily provide feedback about Tucksy, we may use it internally to improve the service.

We will seek appropriate permission before publishing identifiable private feedback, testimonials, private messages or personal stories for promotional purposes where permission is required.

Where quotes from Ask Tucksy are used for aggregate editorial features, they should be de-identified so that individual parents and children are not reasonably identifiable.

Tucksy and its original content are owned by us or used under appropriate licence.

This includes, where applicable:

• the Tucksy name and branding;
• logos;
• original characters and mascots;
• Tucksy the koala;
• illustrations;
• photography;
• articles;
• newsletters;
• stories;
• videos;
• audio;
• guides;
• graphics;
• frameworks;
• original website copy;
• page designs;
• digital resources; and
• other original creative material.

You may access Tucksy content for personal, non-commercial use.

You must not reproduce, sell, license, distribute or commercially exploit substantial Tucksy content without permission, except where applicable law allows otherwise.

The Tucksy name and associated brand assets may be protected by trade mark and other intellectual-property rights.

You must not use Tucksy branding in a way that falsely suggests that you, your product or your business is endorsed by, affiliated with or operated by Tucksy.

Tucksy may use or link to third-party services.

We do not control independent third-party websites and are not responsible for their separate content, products, privacy practices or terms.

The fact that Tucksy mentions or links to a third party does not necessarily constitute an endorsement.

Tucksy may from time to time publish sponsored content, commercial partnerships, affiliate recommendations or gifted-product features.

Where disclosure is required, we will identify the commercial nature of the content appropriately.

Commercial relationships do not change the need for parents to decide whether a product or service is appropriate for their own circumstances.

We may develop, improve, replace or discontinue features as Tucksy evolves.

We do not guarantee that every feature will always be available or operate without interruption.

Where a change materially affects a paid service that a customer has already purchased, we will respect applicable contractual and consumer rights.

Temporary interruptions may occur because of maintenance, security incidents, infrastructure failures or circumstances outside our reasonable control.

We aim to make Tucksy content accurate, useful and appropriately reviewed.

However, information can become outdated and errors can occur.

Medical, public-health, developmental and safe-sleep recommendations may also change over time.

We may correct, update or remove content where appropriate.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or removes statutory consumer rights that cannot legally be excluded.

Tucksy is not responsible for losses that were not reasonably foreseeable when you entered into a contract with us or losses caused by circumstances for which Tucksy is not legally responsible.

Where you use Tucksy as a consumer, Tucksy is not responsible for business losses such as loss of profit, revenue, business opportunity or business interruption arising from personal consumer use of the service.

Your statutory rights concerning digital content and services remain unaffected.

You are responsible for losses or consequences resulting from your unlawful use of Tucksy or deliberate infringement of another person's rights to the extent provided by applicable law.

We may take reasonable action to protect Tucksy, its users and our legal rights where the service is being unlawfully or maliciously used.

Your use of Tucksy is also subject to our Privacy Policy.

The Privacy Policy explains what personal information we collect, how Ask Tucksy and account features process information, how information may be used to generate aggregate insights and the rights available to you.

We may update these Terms where reasonably necessary, including because Tucksy changes, we introduce new features, our legal obligations change or we need to address security or operational requirements.

The latest version will be available on Tucksy and will show the date it was updated.

Where a material change affects an existing paid contract, we will provide notice or obtain agreement where required by law.

We will not use this clause to retrospectively remove statutory rights or materially alter an existing paid service where doing so would be unlawful.

These Terms are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the UK or another jurisdiction, you may also benefit from mandatory consumer protections applicable where you live.

Nothing in these Terms prevents you from bringing proceedings in a court where applicable consumer law gives you the right to do so.
